Termination of Employment in Saudi Arabia

This article will discuss what could happen to you if you find yourself victim of termination of employment in Saudi Arabia and where you would stand according to Saudi Labor Law and what you can do about it.

 

Saudi Labor Law

 

Pay and conditions agreed within your contract should be set in concrete and you are able to enforce them legally through Saudi Labor law and by taking your employer to the courts. If something is clearly stated in your contract (The Arabic version not the English or any other language version) then you will win and your employer will be made to make good by giving you whatever he owes you. If what is written is less than that demanded by Saudi Labor law then the higher requirement is the one that is enforced. You should have a copy of your official contract as it is required when you apply for your Saudi work Visa, most of the time it will be written in both Arabic and English but occasionally only in Arabic; either way you are unlikely to know what your true terms and conditions are unless you read Arabic.

However you hear many times about people not being paid their full wage, being denied holidays and other problems and that they have no way to complain. Why is this? Well many people do not know that they can complain or that they have a court to which they can take their employer or sponsor. Those that do know about Saudi Labor law; also know that if they do take their sponsor to court they could be in for a difficult and long wait.

 

Changes to Employment Contract in Saudi Arabia

 

Termination of Contract in Saudi ArabiaIn the last position that I held the company decided to cut everyone’s salary and benefits as cost saving during the economic crises. Most people did not agree but the company made it clear that this was not a negotiation and that it would be done with or without our agreement. A letter was then circulated stating the individuals reduction and asking them to sign to accept this change to their contract. Of course many people refused to sign, the HR manager then contacted each one that had not signed and informed them that the instruction from “head office” was to let go those that did not agree, which eventually got many more to sign. Only a handful never signed (including myself – more laziness than rebellion) but there was no further follow up, several months later when I spoke to the HR manager he had no idea that I had never signed! However the legality (confirmed by the companies own legal representative) was that the company had no way to enforce the change to our contracts, but to go to court would require us to pay for lawyers, and the case may take over a year to be heard. During this time we would not be able to work for another sponsor, leave the country, and would be at the mercy of our employer who could just then cause us many problems at work etc.

 

Termination of Contract in Saudi Arabia

 

The length of time that any case would take was reemphasized to me several months later when the company terminated the contacts of several expat workers to once again save money as well as comply with the laws regarding the number of Saudis they had to employ. Instead of offering payment to the end of contract which for most of those was several months, they only offered one months notice and limited benefits. Each was only given a couple of days to sign their paperwork and were told that failure to sign would cause the company to withhold payments. If they did not sign and wanted to go to labor court the company would do the following;

  • No wages or any other benefits would be paid.
  • No Transfer of sponsorship would be entertained and no letter of recommendation or letter of no objection for transfer would be given at the end of the case no matter what the outcome.
  • No exit visas would be allowed before the case was settled.

This would basically mean that if the case took an average amount of time in the labor court the individuals would have to spend over a year without wages (and benefits such as car, housing, and health insurance), unable to leave and unable to work for anyone else as you can only work for your sponsor. At the end of this time the person could almost guarantee that they would win their case however they would be unlikely to ever work for another Saudi company!

Most of  the expats being “professional” level employees; engineers and managers had little choice if they wanted to continue their careers within Saudi or wanted to not be stuck there for a year or more without wages, they had to accept the companies offer. Some tried to negotiate additional notice or benefits but only one person that I know of managed to get anything extra.

The behavior towards those terminated was downright hostile and threatening, I recorded one conversation where an employee was basically shouted at by the CEO of the company and told to sign or the offer would be reduced to nothing. The treatment of Expats by Saudis can be far from ideal, and in this case it was the worst I had ever been treated by anyone anywhere in the world.

 

Legal Advice in Saudi Arabia

 

I was one of those terminated, I left the office and sought legal advice as I should have had almost 9 months notice according to my contract and Saudi Labor Law and my initial offer was just one months payment and goodbye! I got a list of lawyers from the British Embassy and set off to see one with my contract and other paperwork that I had to show how terribly the company had been treating me and how it was violating my contract. The Lawyer that I saw was very sympathetic, took my paperwork, made many notes and told me that he would contact me the following morning with advice which at this stage would be free.  The following morning I went into the office to check through emails and apply for some more jobs and was called into the legal advisers office. He had all my paperwork that I had given to the lawyer the previous afternoon. The lawyer was on retainer to the company and just took everything I gave and said and gave it straight to the company without informing me! I could not believe how dishonest the guy could be to not tell me that he worked for my company and would do this! I was so angry, but what could I do?

I phoned around every lawyer on my list and found only two that said they were not already on paid retainer to the company. I spoke to one and he explained that I would 100% win my case but it could take up to 18 months and his fee would be just 15%, paid in advance. This would have taken all of the cash that was available to me as the company would freeze any payments once I initiated any action. I asked if he would accept payment when we won the case if he was 100% confident but he refused.

 

Negotiating a Settlement in Saudi Arabia

 

By the end of that afternoon I had a promise of a job from a fellow expat who held a very senior position in another well known company. So I decided to bluff the company into thinking I would go all of the way to court and see what they would do. The legal director had been very friendly thinking that I believed he was on my side so I went to see him and told him my plans to take the company to court, that I would feed various bits of information back to head office and various other threats and asked his advice knowing that as soon as I left he would tell the CEO..

The HR manager gave me a revised offer the following morning which increased my offer by an additional 150% but I would have to sign “today.” I thought that was very quick and easy so decided to push for more through the CEO. (The CEO who had spent the previous three months having me map out a new structure for the company, creating a new position for myself and doing reports on how to improve company efficiencies!) I met with him and explained that with a pregnant wife I felt that I needed a better offer to tide me over while I looked around for a new job as they were difficult to get (I now had two job offers.) The CEO totally lost it, told me in no uncertain terms that as far as he was concerned the offer will be returned to just one months notice and if I did not accept one months notice then I can go to court if I wanted! Wow, Saudi compassion in action!

I refused to sign and stayed away from the office for two days telling people that I knew would feedback what I said that I was developing my case with my lawyer. On the third day I had an offer letter for one of the jobs so went back into the office to see what was happening, after all I would need the companies permission to change sponsorship.

The HR manager informed me that they thought they could get the CEO to still go with the increased package if I were to agree today. I said that I would consider it seriously but wanted to ensure that once I agreed that I would be able to remain in the kingdom until the end of my current Iqama and the company would transfer my sponsorship quickly and without problem when I finally found a new position,and I would need all this in writing in English and Arabic signed by the CEO. This was agreed fairly quickly so I accepted the revised offer knowing that the new company wanted me to start in 4 weeks time.

At this point I want to revisit a small comment I made above, I had known for some time that the company was to make cuts, I had actually pointed out that it was overstaffed by around 40% to 50% and showed how things could be reorganized around a new structure that would be better focused on the customer and more efficient for the company also. The CEO had had me working on this for three months with myself taking a key role, then he put the knife in my back when I had fully delivered how things should be reorganized placing a friend and Saudi in the role that I had developed for myself to take to help push the company forward. Do not trust anyone in Saudi Arabia, I have had many promise things but few deliver. Most will claim to be your friend and encourage you to speak your mind but then pass on what you have to say, office politics can be very venomous in KSA.

My Friend who I mentioned earlier in this story that had offered me a position was sacked along with every other western expat in the group he worked in shortly after he had made the offer, if I had relied on just his job offer I would have had no job to go to after this one.

If you find your employment terminated in Saudi Arabia I hope you are one of the lucky ones who gets paid all of their benefits without problem rather than be the victim of bullying and blackmail as I was.

    1. your contract with your company is the contract that the courts will use.
    Court case took 2.5 years
    I lost.
    Lawyer cost me SAR30,000
    it is YOUR responsibility to make sure you WORK permit is in order (IQAMA is not a work permit it is a residence permit)
    taking your employer to court is not easy .
    Ask yourself: where do you start…..

      Hi Irfaan,
      Sorry to hear of your problems, this is why I took what I could get and did not bother to take them to court. I know a few people who have taken companies to court over unpaid salaries and they have won, but the cases have all taken over a year and they were very obvious cases to rule. In general in any official dealings it tends to be the Saudi that is favored in most cases.

        Hi Ahmed,

        You cannot force your sponsor to give you a transfer and I guess if you quit they will also not provide you with a no-objection letter allowing you to work for someone else. You are pretty stuck unless you quit and try to return with a new sponsor, but you may have to wait a full year.

    Assalamu Alaikum,

    I was appointed as an Administration Officer in November 2012 and since then I have been working in the company happily. But in the month of July, company transferred me to sales department to work as a sales executive. I don’t have any knowledge about sales but my boss talked to me very rudely and told me that He can put me in any position according to the Saudi labor Law and no one can stop him to do so. He is even refusing me the transportation service and i have to walk 8 km daily in the hot sun that has caused me health problems. Please help me to get rid of him. Jazakallah

      I suggest that you contact your home embassy for some advice as to what you can do with regards to your situation. As far as I am aware they cannot make you work in a role that you are not suited for especially as your Iqama will state what job you should be doing. You can download a copy of Saudi Labor law in various languages if you do a quick search on google and have a quick search for yourself as to what the rules are that apply to you.

      With the speed at which most Saudi companies move I would advice sending anything as soon as possible – three months will just about give the time to open the letter and read it..

    I’m a Expat-Filipino(nationality), in turning 1 year next month February 2013 in such a reason no increasing from salary and my question is this. I’m planning to resign on my company this year and just waiting for my Iqama Permit residency expired this month of May 2013, Is there any possible will my company share with me a half of the total for my airfare or it will be shoulder by myself? And, also In my situation now i already finish my first 1year and 1 more year to go before my contract ends but now I’m terminating/breaking my contract. So, is there any suggestion or advise.Please, and thank you.

      Hi Michael

      You cannot leave the country without an exit visa through your company so they pretty much have full control over you at the moment. If you want to quit before the end of your contract then it is likely that your employ will either insist that you remain or they will request that you refund all of the recruitment and other costs. Of course you may be lucky and have a very understanding employer who will just let you leave.

      What most people do is they ask for an exit visa for a vacation or even a weekend trip to Dubai with friends, pay their own flight and do not return. However if you do this you will not be able to find a new sponsor for one year.

    My husband is presently working in company in Ryadh,I just want to know if what is the rule for the exit or going for vacation,because his company dont allow him to go for vacation for this coming February which is the end f his fourth year contract already,he take a vacation June 2011 and go back at work August 2011..What I want to know is does he really need to wait for August so he could go for vacation again as what his boss told him so?..cause they told him that they must be based on the date when he got back for vaction to complete for 2 years.

      It depends what your husband has agreed within his contract. He will need to discuss with his sponsor but to be honest the company holds all of the power in these cases!

    During work i was injured I went to doctor he referred me for xray,MRI scan and medicine,doctor said i have backbone L5s1 problem so i have been taking treatment from 45 days but still i have pain i told to doctor if i don’t get well from treatment then what should i do he said surgery is the last option.Now my company said it is not serious problem you have to work i told them i can not work so they stop my salary and terminate me,actually it is serious problem because i have pain in my backbone to left leg i can not sit , stand and sleep properly.I really need to go to Pakistan. Sir please help me here my company and doctor behave is not good with me.Please tell me should i go to labor court or not?

    my contract finished September 2012 but my employer ask us to extend because we have cbahi accreditation last December so we extended. now we are requesting to go but still they won’t sign our exit papers because they said we have no replacement. we are already 5 months extended and we don’t intend to renew our contract. please give us some advice on what to do. this is a clear violation of our rights.

    I came to KSA on Dec’12. I’m working as a Mechanical Engineer in a private company. Before some days I got a call from my friend who was selected along with me and staying in India(waiting for visa). He told his job contract was revised from 8k to 6k. When he contacted the company they told “this is not only for you. First we’ll revise the contract for the people those who didn’t came here. After that we’ll revise it for the people those who are all joined/working here.If you want sign it otherwise leave it”.

    Hi i just have a question..will it be possible for me to quit my job here in saudi while im still on my provisionary period? I dont have my iqama yet and my visa will expire 6 weeks from now. I got here about a month ago and since then i do not like the way my employer is treating me and he doesnt follow whats written on my contract. I also do not like how me and my co workers here are being treated like prisoners. The employer locks our door on our accomodation so we cannot go out. Please i need information.     Hi

    I was in KSA about 7 yrs. One of my enemy sent a letter with 1/2grm of heroine (drugs). And i was taken to prison, and my statement was clear enough that i am not involved with this. after 5 months the lower court judge didn’t gave me any punishment but he sent my file to riyadh and after 10 months i was sentenced 4 months jail. After 15 months they sent me back. now i need to know am i a red listed in saudi arabia/gcc/europe/usa countries and if yes than for how many years. Do my record disclosed to other countries? My exit stamp not in red color.Pls reply

    Our company brought 10 of us here on business visas. We have all been given exit visas by the immigration. But our boss is saying he will extend the visas. Many of the passports he took to the immigration have not been extended and have expired. The rest of us don’t want to give him our passports. But he says if we don’t give him the passports he will not pay us. Is he right to do so? Has he got the right to hold us in KSA when immigration has given us exit? What are the options? What about those whose visas have expired ? What can they do?

    I have been working in a company on third party sponsorship(company bought a free visa and brought me in)for 2.5 years. I have resigned on 26 Dec 2012 and waited for more than 4 months and trained a new person who came as my replacement. But, even after following company rules regarding termination of contract, they have broken my trust and given me a re-entry visa instead. i told them that if I wanted to go on a re-entry visa I could have gone 6 months back when my vacation was due. They said, it is not their responsibility to get me an Exit by saying I was not under company sponsorship despite the fact that they are the one who brought me here illegally on a third party visa.

    Is there any way that I could get an exit visa without having to go to court and all the nuisances where I believe that I will not get what I deserve?

    I am not able wait here for a longer period as i need to get home for my wife’s delivery which is expected in third week of May 2013.

    Hi, I just want an advice. I am currently working in a Hospital here in Dammam as an Insurance Billing Clerk but holding a General Cleaner Iqama. In my contract, My work should be a Medical receptionist but when I arrived, they assigned me to be in the Billing Department as Billing clerk. I hold the biggest Insurance company but with a very very low salary. Our manager demands and expects too much from me and I can no longer handle the stress that I got from my work.. I am planning to resign and terminate my contract and willing to pay the penalties (10,000 SR as they said) if necessary just for them to send me back home. Do they have any right to stop me from what I am planning? can you give me some advice and tips on how to terminate my contract legally?

    my mother died last night.. I have filed a resignation letter to my Manager before my mother died but he just ignored it.     I would like to know an employee can change the company without completing his contract with His previous organization.If he comes to India from Saudi Arab after one year and his contract is of two years but he did not go back to work and his residence permit (IQAMA) is expired in this case he can join other organization in same country or not please guide.

    Actually i was working with an organization in Saudi Arab, after completing one year i came back to India and due to my health problem i did not back to work and during this period my residence permit of Saudi Arab (IQAMA) also expired it was not of two years, it was of only one year four month but my contract is of two years now i have one opportunity for same place but company is different i would like to join please guide me should i work for other company I don’t have NOC from previous company.

    I worked for 12 Hours A Day With no Dayoff even once Since I Started Working.
    As I Read my Contract, It Indaicates that My Work should Be Maximum Of 8 Hours a Day Only And 6 days Per week.
    My salary Is 300 Usd And 200 Sr For My Food allowance But I Only get 1100 Sr Per Month.

    i want to asked if my employer have the power to blocklisted me on the arab countries.i went saudi dammam last january 2011.I worked as a dialysis nurse for about 1 year and 3 months.came accident by april 20 of 2012 me and my friend went on a shopping.We rode a car of a lebanese boy my chat mate we rode in his car first time we will meet this guy what happended is that he droves his car very fast and he is calling someone over his mobile unknowingly this is our greatest nightmare with my friend.They raped us different guys and bad guys i thought its my last day on earth.luckily yes we survived from them but unfortunately we loose our job.they sent us back in Philippines they terminated us.they did not find justice for us what I want to asked because i am nurse and im trying to apply dubai or any other arab countries is there a possibility that i will be put on jail?please answer my queries for i am hopeless.

    Dear sir,

    I am an Indian national working in Saudi Arabia from past 19 months. My contract is 2 years and coming December 2013 my contract will finish. But, my mother is taken ill and I have to go back urgently. I requested my company for emergency vacation. General Manager of my branch has approved my emergency vacation but he written my vacation paper that, I have to bring a guarantor for my come back or I have to pay 6000SR to company.
    and Vice president has written on the form that, there is no emergency vacation, I have to finish my contract. I want to go at any cost and even I don’t have a guarantor or I cannot pay big amount of money to company. I told them that, I would go in my cost but they are not responding.

    AS per article 40, (2) A worker shall incur the costs of returning to his home country if he is unfit for work or if he wishes to return to his home country without a legitimate reason.

    Can I go as per this rule? Please help me out…

    I worked 7 yeras in previous company, in last three years there was no increment and no bonus,in the last year company contract with armco also terminated. There was no work as well and people were just sitting Idle.
    After then people strated leaving and company was trying to keep them at any cast, some people were draged for six months and then left.
    I also resined and finaly I got exit after two and half month. They forced every one to sign paper that we shall not come back in eastern province for two years, they refused to give passport untill the paper is not signed.
    So there every body signed and left, some of the people came back and joined different companies, I also joined one of comapny.
    Now I heared that our previous company filed case againt some of the people working in an other company, company won the case and the court order their employer to send them back within a month.
    I am also in same boat.
    Please advise whether is it possible, if yes how we can fight and save ourself.

    I need someone who is adept with my concern and that s/he be able to shed some light to me with respect to my concern.

    Here’s it. I’m nearly ending my third year as an EFL instructor in one of Jeddah’s technical institutes.

    What laws say the number of months of notice must one’s resignation be in effect? Is it two, three, or four months? If so, please site sources (online links) for me to be enlightened cz my employer told me it’d take four months while some say it would take three, two, or even just a month.

    My purpose of resignation is better job opportunities because of competitive salaries and benefits which my current employer could hardly extend among its employees.

    Please Help me that i worked in company total for 8 years.
    I came in that company on transfer sponsorship before 8 years.
    Now i got very good offer and i already have submitted my resignation and now my notice period for one month also finished and i started my job in new company also.

    All related my job in my old company i got clearance from new replace person.And i am complete clear from there as officially.

    Please tell me in all above status my old company may give me Final Exit very easy or.
    For this i may go to labor court because i do not want final exit i need Nakal Kafala from old to new company.

    Please help me admin if you have some points for this.

    I need a sincere advice. I accepted a job offer in Saudi Arabia two months before and the company issued a visa. Meanwhile I got another offer which is much better than first one. Can I accept the second offer now? Can the second company issue a visa for me? How can I refuse the first one? Please advise according to Saudi laws.

    my brother got terminated from his company last june of this year and he is planning to come back here in saudi by september..how will he know if he is not blocklisted here in saudi? for how long will he be blocklisted?and what can we possibly do to clear his name in the list?.

    I have been working in my company for 21 months and supposed to be my contract will be finish this coming october but my employer terminated me. It is that my obligations to pay my repatriation back to my origin country and also pay for two months left from my signed contract?

    My question is that i was sing my contract in India for 2 years given by agency and when i was come in Saudi Arabia and start my job after 5 months company give me contract paper and i was sing for 1 years and in contract 30 days annual vacation. and company not give me copy of my contract. now i complete one year and i talked to my manager regarding vacation he told me you sing in India for two years. but i want to go in India can you help me what i do regarding my vacation.

    Hi Im newbie here in Riyadh KSA. Nurse from Philippines. Just want to seek some advice regarding my situation. Ive been here for 4 months but unfortunately Im not working in the Clinic which is in my contract. The reason of my employer was our clinic isnt yet open and the license is still under process. They send me to another clinic but I worked as a homecare nurse. 12 hrs/day (required 4 hrs OT). Regarding the salary, they underpaid me too. Im very disappointed and just wish to go back in the Philippines but my concern is, who will be responsible for my ticket, exit visa etc? What will be the best first move regarding this?     I want to ask for an advice regarding my case. I am currently living in jeddah, KSA and i am under the sponsorship of my father. I was hired as a Staff Nurse in one of the hospitals here in Jeddah. The hospital promised me to transfer my sponsorship under them. I signed a contract last July 2013 (locally hired) and the years of my contract under them was not specified. No housing and no benefits. I expected this as i was signing a contract under locally hired. They told me that my 2 years contract will start after being transferred to them. They are able to transfer my sponsorship under their hospital last October 2013 but there is no new contract given to me for me to sign. This December 2013, i decided to resign since my application for studies in Norway has been granted. I need to go back to Philippines to process all my documents to be able to finally enroll in a University in Norway and process for my student visa. But unfortunately, they did not allow me to go. I told them that i did not sign any contract stipulating my years of contract under them. I am still under locally hired employee. All i want is a peaceful exit and if i need to pay the fees they costed for my transfer, i am willing to pay. Additionally, I am no longer reporting for duty 1 week now. Please help me. What will i do? All i wanted is to go home so that i can pursue my dream of studying abroad.

    Assalamu Alaikum,
    I have expertise in ERP functional (more than 10 years) with MBA-Finance. I came here on azad visa as general accountant…..I mean on my own visa. Then I found job and I gave transfer to new company. At present job, my boss is continuously blackmailing me to change my line and become a programmer with multi languages otherwise he will give exist me from KSA and band me for 5 years in KSA. Even no transfer will acceptable from this job other than only exit from KSA. This is a mental torture for me while performing my functional task.
    I mentioned him may times that it is impossible to change it because my experience is purely functional, for being a developer one should have that level of educational background and mind set which I do not have.
    I should I do if he did I said to me; fire me with some blame of theft or data manipulation. Note that I am here on my own vise not sponsored by present company. What is my legal right? How I can process on it? Cost and expected time?

    Gents…need an advise.

    Im working in construction company for more than 13 years and 11 months. Last January 2014 i received a termination letter stated termination of contract for the reason: service no longer required. This termination was accepted by myself with no complaint/ objection because i knew the company have the rights to terminate. In bargaining with my termination. i requested for a release of sponsorship in which the CEO duly signed and approved my request. Furthermore, during the 30 days notice i looked for new job and i found one and request for a demand letter in which i submitted to HR manager after the 30 days lapsed. 30 days have lapsed and my demand letter still on hold which means i cant work to a new employer. Recently, i visited the HR office to follow up my status but unfortunately, there is no crystal clear answer of my question…either the release of the sponsorship or going home to my country?. And now, 20 days have passed from the deadline of 30 days notice still i am hanging on the tip of the knife….please advise what im gonna do. I am worried of my settlement for 14 years and my new job.

    Hi,

    I worked in saudi for almost 2 years.
    The company first give me visit visa which was renewed after every 3 month. My first visit visa was extended to about 12 months then i came back to my country on visa epxiry.
    The company send again a visit visa which was also extended upto 12 month and on expiry i came again to my country.
    This time they said they will send a permament visa but they did not send and waited for about 4 months. During this four month I did not get any salary or any earnings.
    Now i accepted an offer from an other company from saudi and joined them.
    Before joining my new company i wrote my old company to settle my dues becuase he had no visa so I am unable to continue with them due to their fault.
    Company has not given dues like end of service and vacation pay etc.
    Please advise my can complain this to saudi labor office for settlement of dues.
    Looking forward to your advise and detail reply to above case.

    Please let me know if an employer can terminate the contract after been asked from an employee to signed and served the notice period in the current company.
    My problem is that i was in job and got a bettr job opportunity and an offer ,HR dept of that company has sent me a contract congratulating me and asked to signed back and sent to them and state joining date.i did so,,and resigned from the present company and was serving notice period of one month,which my employer knows,during the notice period i asked many times fro HR dept to give me demnad letter and they always replied a month left we will give you the letter once you finished notice period,but now they stepped back and refuse to transfer me to the company.can i take legal action?as iam jobless because of them,resigned from the present company based on their offfer and contract.please state my position

If I leave without informing my sponsor(ie going for vacation and wont return) , will I be able to go to Dubai?     my problem to company is the company has terminated me to work becauseim involved to a case that i can not do one of the filipino worker has doing a certificate of employment and selling to other employee and he catch and this guy told that the usb with format he use is came from me yes i know the usb is came from me but i dont have any idea what happen and what this filipino doing and for that the company cannot make any investigations about this matter,the company urgently terminated me and the one who make and selling certificates and the company told that if we cannot agree to the settlement we will go to jail a afraid because im innocent why im agree the company make a letter that we will go home if i will pay the expenses of company like iqama ,visa and work permit and also our ticket is our own money what i can i do because i have no money to pay to company because we already terminate i hope you will help me and give me some advice regarding to my problem thank you sa much and any help given will be highly appreciated..

    I took a medical leave in my home country for 1 month without notice to my Job Site manager since several times that i discuss about my health condition with them but they never attending my request and also not signing my vacation leave. So, my second option is to ask request for my principal sponsor to have my 1 month medical leave vacation but asking me for approval to my Job Site manager and so i give an old approval letter which is signed by my Job Site manager last year. This action took me into approval for my leave. After i came back from my medical leave, my Job Site manager didn’t allow me anymore to work with them due to inappropriate action i made. Meanwhile, 1 month after my come-backing here in saudi that was already my end of contract period and I want to exit so i can able to look for another sponsor, but actually i found a new sponsor willing to hired me but i need to settle first my problem into my principal sponsor. In this case of my history, do i have a violation prior for my principal sponsor to hold me and not to give me an exit visa since i already break or stop working in the my Job Site? Is there any consequences that i may face in case matter where in i want to go home rather than staying in saudi without work. Please give me your idea in this matter.. thank you

    Hi. I really need your advice. My exit is on november 2014, i already submitted all the documents needed in my exit last august 2014 for out 3 months notice policy but until now may head of the department do not want to sign my exit papers. I just want to finish my contract according to the schedule. They are telling me to change the date extending me to 1 month extension but i do not like because i need to go home after my contract finish. I am always following it up but they are taking me for granted. What will i do now because it is one month before my exit schedule then the processing did not start yet. They are telling me to extend for 1 month because there are no staffs but i do not want to extend. Please i need your legal advice about this matter..

    Myself shoaib, I was working for an organization and suddely the management terminated due the niqaty issue at the time of termination my iqama valdity was for 7 months. And after 4 months I recived a call from my comapany saying “do transfer in 1 month or management going to put exit. My iqama has still 3 months of validity please can u guide me with the fact of rule in KSA regarding “after termination how many months I have rite to stay nd hunt for a new job and are they having rights for giving an Exit”.

    If there is a possiblity of being legal and looking for an another job can u send me the link than I can show to my Ex Organization.

    Hi..my iqama is currently expire and my employer doesnt want to process my papers because i’m exiting his company..then hes telling me that i will not get my benefits and salary..i am already 6yrs and 1month here in riyadh..but there is this paper that we’ve signed indicating a salary increase and contract written on it..is this contract acceptable without the laws attached on it and signed?..do i have to get what is for me even if i’m 3months under my new contract?please help..thanks a lot..

    I have some question that wanted to be clear,first of all i want to terminate the contract of my employer due to some personal reasons, i did submit resignation letter to them until end of march 2015, my contract will be finished on January 2016,but then they told me that i need to pay them about 9,000 SAR together with the airplane ticket,is that fair to pay them on that amount? because im not a titled employee i’m just a waiter/food server on a Restaurant,the must review my annual income per month right? can you please give me some feedback about this and to whom i can hooked some help in case of..

    I am 5 years and 6 months now in my company, before they hired me five years ago they promise a good accommodation with pulley furnish and i am alone to the room to give me more privacy, but when i just arrived here my accommodation is just like a container ban and we are 6 person in one room, but thanks be to God that my other 3 colleague was file an exit, now this year they make a renovation for the room and it become more smaller and they planned to be accommodated by 6 person again, to make my situation short, though i have the right to ask the administration of my company to give me the housing allowance in order to me to live out the company premises?

    I am working EPC Contractor with Saudi Aramco Project in a prominent position. My extension contract is finishing on 28 Feb 2015. I have given my request for non-renewal of contract by email. Admin Manager requested to stay until May 2015. However, I have health and personal problem, hence, I don’t want to continue. I send one job for printing and finally we discovered that there are small mistake from the address of the company profile that we print, that led to client rejection of the printed material, my manager told me that he will deduct all the printing amount to my salary, is this legal?

    I was working for almost 12 years in Saudi and company terminated me for administrative case but mentioned in the termination letter that I will receive my final settlement after 30 days notice however after my 30 days notice pass they hold my Gratuity and informed that they discovered I did a gross miss conduct case. Do the company had a right to do this and not to give my gratuity? and do I have a right to sue the company to the labor court?

    Please can I terminate my contract within six months ,, I am only a month old in saudi arabia, and will I pay anything to my employer, or will he pay for my return tickets to my country, nd will he give me my 6 months salary,

    I was hired as a service van technician here in Jeddah. But before I agree to sign the contract. I ask the HR personnel a simple request. Because before he hired me I already have a contract in a very popular car company here. The offer from that company is a little lower than this company. So I decided to accept this offer with only one condition and that is I only prefer to work inside Jeddah only. He said its OK because your jobs is inside jeddah only. A guy will pick you up and send you to the job site and send you back home in the afternoon. That’s why we agreed. Before I signed my contract I ready it several times to make it sure that there is no conditions that may send me to trouble. Everything I going good since the day I started to work at the company. The company gives all the benefits to all off us. But after a few months my boss did some unhumane acts against me. The first one is when I got sick. The doctor told me that I’m having a problem with my gallbladder he said I need to undergo an operation but before that they need to door some series of examinations and medications. The doctor ask me to do the followup checkup every Saturday. On the first week my boss send me to the hospital for my checkup. But then on the 2nd Saturday he refused to send me to the hospital even if I show him my followup card he want me to go there at night but my scheduled time is 8am so if I go there at night maybe the doctor will not be there at that time. Luckily the pain subsides because of the meds they gave me and until now I’m still alive but my Aunt 1 of the best doctor in my country said that sooner or later the pain will strike you again it only stop because the meds control it. The 2nd violation did by my boss is when he send me to Riyadh without any further notice and any assistance from him. I still follow his instruction because his my boss but when I arrived at the airport the personnel told me that I cannot bring all my stuffs to Riyadh he said I should pay extra for my baggage. Because I didn’t have proper preparations I cannot pay it because the money I have that time is only 340riyals. I ask my boss to help me but he said no the only way to send my stuffs there is to leave it here or pay the amount. I didn’t have any choice but to leave my stuffs back to my apartment cause I already paid for it until June this year. When I arrived in Riyadh a new boss is there he pick me up at the airport and send me to the job site and leave me without any advice or assistance where can I buy the things I need where can I get food without any knowledge and stuffs I need in that place I tried everything to provide my needs. But while I am there in Riyadh I send some emails to the head office here in Jeddah to send me back. I spend almost 2 months in Riyadh when I received a call that the head office will send me back to Riyadh. The client that time also told me that tomorrow will be your last day here in the job site because of that I called my boss to arranged everything for me. My boss talk to a friend of mine if I can stay in his place for at least 2 days and after that I will leave. My friend say yes then pick me up in that place and send me to his place. My friends only pay a very small room there that is why that is why one of them needs to sleepover a friends room for at least 2nights. With that I’m still working while waiting for my ticket. But its the 3red day but still my boss there didn’t arrange anything for me. I knew the people there in my friends place is getting mad at me cause they say I will only stay there for 2days but now I’m on my 3rd day in that place. I heard some bad words and see some bad attitude every time I pass by their way. That’s why I talk to another friend if I can stay to his place for few days. My friend told me that its OK if I stay in his place. So I told the first guy that I’m going to leave his place and if he can send me to my other friends place. While I’m staying there I’m still doing my Job everyday but I also ask some feedback to my boss regarding my transfer back to Jeddah he ala ways say that I will try in sha’ Allah. Its almost my 2nd week since I left the first job site and also its my 2nd week of waiting for my plane ticket to jeddah but still no updates from my boss so I decided to send a message to our department head here in Jeddah the after that I received a call on that day also that my flight is tomorrow at 7am. And guest what no assistance again comming from my 2nd boss. Everything happens to me is because I have lots of friends who helped me at all times. I arrived in Jeddah and I was surprised when my old boss picked me up at the airport and send me to my apartment before. The next day we worked even on Fridays because all the job is urgent and until now we need to work if the client needs us. Because as we all know Saudi has a war at this time and our schedule of work is also affected because of that. Then my boss called me that after a few weeks here in jeddah that I will be transferred to Madinah but I said no Sir because I’m not a Muslim and I’m not allowed to go other Sir. Then the next day or should I say yesterday he called again and told me on week end you will be transferred to Bisha. But then again I refuse to go there because at the first place I already experience twice how they do the transfer procedure and 2nd is I have a deal with the personnel department head that before he hired me is that I will stay in Jeddah only although it is only a verbal agreement i still count on it cause base on a book an Arab people also respect a verbal agreement. and the last reason is my job description is a Service Van Technician. But now my boss ask me to do the Job of a Technical Service Manager without any signed documents that I’m going to perform this job. My only question is do I have a right of terminating my contract because of this situations? And what will be my benefits after the terminating of my contract. Will I need to buy my own ticket to go back to my country. Please help me sir. Thank you very much…..

    My name is Ashish Mihsra and I hail from India, I came here approx. 2 months ago with an employment Visa under a company sponsorship, Now the company is saying that they want to terminate me and want to send me back to India!!

    However, for your kind info, I would like to let you know that i was in Dubai for a good company whilst I go hired by this company, now the situation is if they terminate me by claiming I don’t perform well, I will be JOBLESS which would route me to the worst financial conditions along with my family.Is there any way-out as I can find a job here(actually I am already talking with few companies) or what all legal steps could be taken in order to get the release from the employer? I guess, its really tough to judge an employee within the time frame of 1 month or so..!!

    Hi,

    I was hired by the company in the month of August 2014, they made 2 years contract by me. But the company terminated me within 8 months of service on March 2015 with given 30 days notice period without reason.
    I asked HR the about the reason of termination in orally, they replied about cost cutting of the company. Even though they are not giving me transfer.

    Could you please suggest me,

    Is it possible to complaint in Labor Court ?
    how can I take a step to complaint on them ?

    my name is nawaz and I am a graduate I am in Saudi from the last 5 months but I didn’t get my iqama I asked for it so many times but my employer who is an indian always says that it is on the way , but when I checked online I got to know that “Hurrob” is set on me. I was shocked seeing that bcoz I am working in the same company but still hurrob is imposed on me, then I inquired about this internally then I got to know my company is in red catogery so no new visa will be issues to it ,so for that my employer who is an indian had buys visas from other kafeels and after that he intentionally puts them under huroob so that he get another new visas and after geting new visas he pays the fine to remove huroob and remove huroobs , this is the illegeal way for getting visas.when I asked him about this he was furious on me bcoz I had all the thruth he said I have to face the concequencys for this , he demorted me from supervisor post to salesman and has stoped my salary from the last month . I didn’t to work in this company so I asked exit but he is not giving it .so I have decided to go to court . What is your sugesstion to get out from this.

    I had a agrement of my post, working hours,annual leave etc but it is in English is it helpful or not if I go to labour court .he is taking 13 hours of work me as a salesman and as a labour, but in the agrement it is clearly stated that working hours are 8 ,and my post is as supervosor . And another thing is if I go to labour court he will simply say that I am on ones visa and working in another company but I have all the proof that I am working under him and plus agrement please suggest me what to that bcoz I am a fresher and didn’t know any rules

    my company has terminated an employee due to losses the company was going through. The company gave 1 month notice as per contract, so that he may look for an alternate employment. Can the ex employee continue to look for an alternate employment indefinitely, or should the company give him a reasonable period & take an undertaking to get a job within agreed period or what legality is involved, because the company does not want him to get caught while working for another company without transfer due to present raids etc; nor the company wants get in trouble due to such situation, wherein one of his ex employee was working without transfer. what is your advice ?

    I am presently working here in KSA as an Executive Secretary since 01 March 2010.
    Last 2 weeks I went for a quick vacation (5 working days) which was approved by my supervisor. Though I was on vacation, I usually check my emails to monitor whether my boss emailed me. In the 4th day of my vacation, I was really shocked and surprised that he forwarded an email informing our department and HR department that I am being replaced as his exec. secretary and replaced with our document controller. I tried to call him to check what was the problem but he told me his on a meeting and will call me back. but he didn’t call me. I send him an email but I found out the my password was replaced. I tried to call IT dept. but they told me that they cannot reset my password because my supervisor told them to change it and not to reset it without his approval. I was totally at a lost and don’t know really what happened?? After my vacation I reported to my dept. and talked to him. He was really so upset and he told me that I AM A LIAR..i asked him on what occasion did I lied? and he told me that I lied to him of where I am going for vacation and he told me that he instructed me to change my visa request from multiple to single. I told him I didn’t lie to you of where will be the location of my vacation and i didn’t even request for an approval of a multiple or single visa. I already informed you that i already have a visa and what i only requested is a 2 weeks early passport release. But he was totally upset and didn’t listen to my explanation. It was just totally a miscommunication. I even told him that i was offered by our Gov’t Relations for a multiple visa and i even told our gov’t relations that i am no longer eligible for a free visa and it will be under my account and not with the company. though i kept on explaining my side he didn’t listen to me. i was investigated by the HR department and told then the whole story. All documents related to my vacation was signed by my supervisor and government relations issued a multiple visa to me upon my payment. Until this date 2nd week i don’t have any position nor department to work with. I am just being asked by my supervisor for a turn over of duties and responsibilities. I check with my supervisor this morning what is now my status and he replied, check with HR dept. but i checked no concrete reply from them. I was also informed by my friend from HR dept. that they are working on revising my contract which contains a demotion of my current position and also a revision of my salary. Sir, is it legal for them to demote me and cut my salary? I am totally at a lost and really don’t know what to do. I am being accused of something that i didn’t do nor plan to do it. I was convicted or penalized without having an investigation beforehand. Please help me and hoping to hear from you soon. Thank you so much.

    my friend is working in a company for the past 4 years, and his contract was finished on last may, now the company give him a termination notice and they tell that your contract is finished and they will not like to renew the contract so you have to go from here before 15th august, in this case i just want to know that whether he is entitled to any benefit

    But my current employer is not allowing me to resign my position because of no replacement.

    What legal reason i can tell to my employer to allow me resigning on my current position. and start working to NEW Employer.

    Hi. I requested vacation after my 1 year contract. Which is as per agreed contract with the company. But they rejected it . Thats is I gave them notice for contract termination just 5 days before my end of contract but willing to stay to finish my term and they ask me to stay for for more than 30 for my exit processing. They did not give my vacation pay intead they force me to pay them the amount equivalent to the 4 days of my salary because I gave them late notice. What will I do. Is that right?

    If the contract just says “The Employer will pay to the Employee his full termination service benefits.” What does it mean? I am assuming this clause applies if the employee is abruptly, without notice or any justification is summarily dismissed/terminated. My question: What are “full termination service benefits” in this eventuality in KSA?

    I have a question about contract.
    i have 2 years contract and now i want to resign after 1 year because company is not in good condition and also the boss are not good.
    and our contract stated that
    ” Any expatriate joining the company on permanent visa and decided to leave the company before his contract then employee will pay all expenses incurred by the company such as Visa Fee, Iqama, Air Ticket, Recruting Agent Fee and any other related expenses . ”

    is it possible that i can resign after 1year without paying anything.

      Hi Jeffrey, you signed a contract and knew what the conditions were – so your choices are to pay or finish your contract. You have very little real power in Saudi. Most employees will go home on a vacation and then just not return to avoid this but then you lose out on any benefits etc.

    Hello,

    I was forced resigned recently by my employer from a senior positions based on office politics.

    I was given a day to either face the termination and don’t get anything as benefits or resign as they don’t want me there anymore and get 1 month salary. I resigned but everyone knows that it was forced because I wasn’t allowed to stay in the country by the employer for more than a week.
    I returned 2 weeks ago and furious now and wish to take an action against that humiliation and termination of contract. My contract length was on going as per the agreement.

      Hi Ausaaf, you can take action through the Saudi Labor court however this can be very time consuming so you may just wish to take what you can as you will not be able to work for another sponsor while you still have a visa with this employer.

        I was sent out of the country within a week of that decision and my Iqama was cancelled.
        I am back to UK and looking for new job for the last 2 months, which is a shame. How can I go about them compensating for my unemployment? The original contract was unlimited period of time.

      The last time I checked Saudi Labor Law I believe that it said that expats can be employed up to the age of 60. You can download a copy at http://www.gulftalent.com/repository/ext/Saudi-Labour-Law.pdf The main clauses with regards to your contract length are 52, 55 and then 37… However article 74 clearly states that the contract can be terminated when the employee reaches 60 years of age..

      Jordan,
      All you can do is talk to your employer and also your embassy. Unfortunately employers in Saudi pretty much have all of the power. If you have a contract they may ask you to pay them for flights and other costs as that is what I often get messages about.

      I would suggest, don’t go back and meanwhile try to have your iqama transferred to any other supplier with better contacts in the market who could get you a contract work quickly, for example, RFID for IT contractors.

    Sir Good day..what can I do? I sign contract in two years contract in my country..Here in Saudi my contract change into 3years.. My company want to force me to sign again 3yrs. If I will not sign 3yrs my salary will be automatic 1600+200.. But in my contract 2000+200..then my company said if you are merried your contract is two years.. If you are single your contract is 3yrs…I don’t know what kind of system is that ..

    That’s why I sign new contract of 3yrs.
    Now I’m 2yrs and 2mos. Working here in Saudi Arabia…

    Feb. My iqama will be expire this coming Feb. I don’t want to renew my iqama and I stop to work because I fight my contract 2yrs. Only in the Philippines..I want to go home

    Please response me Sir.. I need your advice Sir…what can I do?

    I was terminated and 30 days Notice Period was given to me. Someone telling that it is 60 days not 30 days. Once I was terminated my contract was in due 13 months. Can you advice me?

    I am Terminated from job and my account is settled but they don’t have the money to pay my Iqama & Exit Visa are expired at same date can I transfer my Settled amount to another person, If yes please tell me the Procedure

    Dear Sir,
    Greetings to you. I’m employed (resident permit) here in KSA from feb’2016 with platinum category MNC in riyadh. I got my iqama within a month. Now i’m getting new offers from some other company with good salary package. My company will give NOC, but not a sponsor change.Just i want to know, how to change my iqama to other employer? or if i get final exit with NOC, whether i need to take all my GAMCA medical & IQAMA medical once again for getting new visa?

    I signed a 2 year work offer with a company in Saudi but after 7 months in Saudi still did not recieve a contract and they failed to issue work permits. This was done to several of my colleagues. Many of them were fired and signed termination agreements with a month’s notice. I was however assured that my services would not be terminated. However when I returned to South Africa for my annual vacation I was promised that the contract would be signed when I return in July. While I was on vacation the company e-mailed a letter for termination of my services and expected me to sign it. They offered no reason for termination of my service and refused to commit in writing that they would pay at least a months salary as well as leave pay owed to me. I did not sign the termination agreement as to me this seems to be an unfair dismissal. Surely they cannot terminate ones services while you are on vacation, without reason and not give proper notice? Does Saudi labour laws offer some remedy in this regard? I cannot afford to be engaged in costly legal procedures and hope that I could at least receive what is still owed to me.

    My company terminates my agreement article 13.
    So what meaning of article 13. Can you explain me?
    And the company not gives me one month notice pride salary. They said you are working on this month. But I get that month salary for my working not for notice period.
    So please give me same advice hat I can do.

    Hi! I just want to ask your opinion regarding my situation right now. I’m working here at Saudi started last May 2015. I’m under a subcontractor and work in hospital. I have a signed 2 years contract that will end this May 2017. As of now, our employer informed us that they will end their service to the hospital this January 2017. They have contract to the hospital until January 2017 and they will not renew. They added, if we will exit they will give us the benefit and airfare tickets. So, what goes in my mind if they will finish January 2017, I have still 4 months remaining in my contract. We follow up our question, we ask if they will pay our remaining months. They replied, they will see. Do I have the right to get my remaining 4 months of my contract? They should pay me before I leave?
    Please please help me with this. Looking forward on your reply.
